HMO landlord responsibilities: the operating checklist

Licence and occupancy control

Keep the licence, permitted occupant number, expiry date and conditions in a property file. Check that the actual household and room use match the licence. A change in occupants or layout can change the licensing analysis; ask the council before treating it as administrative.

Management systems

The Management of Houses in Multiple Occupation Regulations require practical management, including keeping escape routes clear, managing waste, maintaining installations and responding to defects. The exact duty depends on the property and regulations. A written inspection log is more useful than a general promise to ‘maintain standards’.

Record every report: date received, risk, person responsible, action, contractor and completion date. If work cannot be completed immediately, record interim protection and the reason for delay.

Safety and records

  • Gas and electrical safety records where applicable.
  • Fire detection, alarms, doors and escape routes checked and maintained.
  • Water, heating, sanitation and shared facilities kept usable.
  • Occupancy and room records kept current.
  • Copies of licences, notices, inspection reports and contractor invoices retained.
  • A route for tenants to report urgent hazards and a clear emergency response.

What a tenant can do when the system fails

Report the issue in writing, keep photographs and dates, and contact the council's housing-enforcement team where there is a serious or repeated breach. Do not enter dangerous areas to collect evidence. Council records, notices and inspection outcomes may matter later, but the immediate priority is safety.

Questions people ask

Can a landlord enter an HMO without permission?

Access depends on the tenancy terms, notice rules and the urgency of the problem. A landlord should not treat an HMO as permission to enter private rooms whenever they want; use the proper notice or emergency route.

What are the new rules on HMOs?

Rules depend on the jurisdiction, property, licence designation and date. Check the current council licensing scheme and the GOV.UK guidance rather than relying on a generic social-media summary.

Can neighbours complain about an HMO?

They can report suspected licensing, nuisance or safety issues to the relevant council. A complaint is not proof of an offence, but a council inspection or notice may create useful official evidence.
