Start with the qualifying offence
Not every housing complaint creates an RRO. The conduct must fit a specified offence and the evidence must connect the respondent to it while the tenancy ran. Examples commonly investigated include operating an unlicensed HMO where licensing was required, breach of an improvement notice and other offences listed in the current legislation and tribunal guidance.
Separate the underlying problem from the legal offence. ‘The property was poor’ is not enough by itself. Identify the notice, licence status, management breach or other statutory fact and save the council or tribunal record that supports it.
The current rent period matters
For offences committed on or after 1 May 2026, this site's current guidance records the possible period as up to 24 months of rent paid; earlier offences may be subject to the earlier 12-month limit. Transitional facts can change the calculation, so record the dates precisely rather than applying 24 months automatically.
The calculation starts from rent actually paid and may require deductions or apportionment. Keep bank records, rent statements, benefit information and a month-by-month schedule.
Evidence that survives a tribunal question
- Tenancy or occupation evidence showing the period and address.
- Rent payment evidence and a calculation that can be audited.
- The council register, licence, notice or enforcement record.
- Photographs, inspection reports and dated messages where management or safety is disputed.
- The identity and role of the respondent, including any agent or superior-landlord issue.
- A chronology separating what you personally know from what a council record says.
Do not mistake a public decision for a guaranteed result
Published cases can show how a tribunal approached facts, conduct and quantum, but they are not a tariff. Read the actual decision and compare the offence, dates, evidence and respondent before using it as an analogy.
